Hi,
If the Dems win control of the Senate, I expect no major changes for us. The amnesty bills are already passed easily in the Senate as is anyway. That doesn't change anything for us there.
In the House, this will be a close race. Even if Dems barely win in the House, what is less likely, then they may well find themselves struggling again to get major votes for the amnesty bills. Remember that the amnesty bills got rejected in the House by large margin - and - enforcement only bills got approved there widely. Our stand alone SKULL bill - not sure whether that will be considered by Democrats. Democrats will probably address the Dream Act before they take over the SKULL bill. Let them pass Dream Act, and then we, the Employment Base applicants will be in a real dream for a long time.
It won't be easy, folks.

I was confident on this before, you have just made me super confident.
I have been saying all along that one can get a same/similar job after 180 days irrespective of the whether I-140 was approved or not. I don't know why some people / lawyers spread so much mis-information on this topic.

i was not able to attend the IV rally..emergency reasons..but still its fair for me to suffer..
its highly unlikely we can see a reform. I agree with logiclife's post..we deserve what we are getting into..
of the 800K applications u saw applying for AOS..even if 10K had come to DC rally it'd made a huge diff..
we all do line up for GCs like herds but dont have the guts to attend..
i know of so many ppl who say "all this rally is ridiculous".. and i dont pity them those who wait for 10 years..becoz u deserve to suffer and will continually suffer..

I just got an email (not magic though) about EAD renewal approval. It was paper filed on 14th June. Not sure if it is for 2 yrs or 1 yr with my priority date current.;)

So you are laid off so what is the big deal? You should be able to negotiate somehow or escape layoffs by doing something or the other. There are people in my company who survived 6 layoffs. Your layoff is your problem and nothing is fair in the globalization.
Actually my company went bankrupt and eventually everyone got laidoff...

We have had to give up our dreams stuck at the same job for 5-6 years..Did not take promotions, pay hikes with fears of screwing up the GC process...many got laid off....
The process is just screwed up..no other country follows it and it is the same process from last 20 years...

Hey All,- I've not been that active, but will try to be hence forth. Below are my proposals to rephrase the present 'Flower Campaign" press release. I'm open to suggestions.
I felt the need to explain "why the over subscription and what part USCIS had in it" and also in the mean time point to the "overzealous work done by USCIS on June 30 and July 1st".
Sentence in the press release: However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
My take on this: Due to inefficiency of USCIS in the past years, 187,000+ visas have been wasted according to Ombudsman report. This act is to be blamed partly for the present scenario of over-subscription of thousands of law abiding and tax paying highly-skilled workers, including engineers, scientists and health care professionals who have been waiting patiently for years in order to be eligible to apply for their Green cards.
USCIS's sudden backlog reduction efforts during the past month have resulted in the use of almost 60,000 Employment numbers among which 18,000 were used on June 30 (Saturday) and July 1st (Sunday) according to (Quote source).

SRC is always Texas , LIN is Nebraska. Also when you input the receipt number in USCIS case status website it tells you which center this application is with.
I understand that. What I wanted to know was what number you have? SRC or LIN? And also to confirm, if it was cashed by TSC? and not the case that it was cashed by NSC and then scheduled to be transfer to TSC?

Any lobbying for immigration is tough at the time of recession. I think you are trying to do advocacy effort. Without getting approval from core IV group it will not be any use as advocacy effort only will not work. Senators will note your concerns and will act only if some bill is introduced. You need lobbying with advocacy effort for changing any law. Lobbyists will lobby only at right time as if they do in wrong time it will backfire.

For people on H1B any wrong step will cause government to shut down the entire immigration or punish immigrants. They did it with TARP and now they will do it in every industry if we do not understand. The newspaper headline will be H1B Indians immigrants asking for greencards after taking American jobs. Like it or not, but this is how antis will show us and all Americans and lawmakers who are sympathetic towards us till now will support antis due to bad economy and for the need of Citizens to stick together in bad times. You have also made this issue of Indians and that is a big no no. Indians now getting a bad name and have become notorious and if you highlight 'Indians' then you are in for a failure. So any campaign should be about all immigrants and not just Indians. Indian Immigrants are having a bad reputation in IT circles these days.
Guys do you know that economy is going from recession to depression? I read somewhere that in the last depression they shut down immigration. So let us not do anything that will be hard on H1Bs just because you have a secure EAD cards.

When I joined Company X (prior employer) I paid for H1b transfer fee and h1b renewal fee(total $3200 + $3000).
They agreed to sponsor my green card(just to give required paperwork) and they asked me to pay GC cost, So far I have paid $1500 for labor +$1700 advertisement + $1700 for I-140 + $3750 just now to file I-485 for me and for my spouse as dates were current to my lawyer . I have labor and I-140 approved from Company X.
I was compromising my personal life by staying away from my family and company X didn't find any client near to my home. I decided to stay at home hoping Company X will find some client near to my home. I was on a bench(no salary for a month).When I asked for a "employment letter "to file I-485 Comapny X said they can't give because they are
not paying me , I said I will resign and then you give me "future employement letter". I resiged Company X( i found company Y near to my home), in 10 days they cancelled my H1b visa without informing me, gladly I found Company Y and H1b transfer took place before they could cancel my H1b. Company X is reluctant even today to give future emplyement
letter.They are ready to do corp-to-corp, for that I have to pay them H1b tranfer cost of $3200(as my prior h1b got cancelled by company X) . I don't beleive its worth going back to them , but at the same time never wanted to lose $8650 green card cost. To join Company Y again I paid h1b transfer fee and , company Y expects me to pay Green card cost again. I am on 7th year extension. New H1b is valid till 2010(3 yr extension on I-140 approval from company X).
Shall I start green card again with company Y ?
Company X doesn't respond to emails/calls. There should some law to protect us from such employers. BTW Employer X was an american employer and wants to follow book-rules.Example .. informing USCIS to windraw H1b petition.
