with LC sitting in BEC for 5 years or more it does not. There are many many people I know whose PD could not be recaptured because of the insane amount of time LC certifications used to take. With PERM its a 5 month + 15 day (if I-140 PP is restored) thing; in my time (gosh I feel like an oldtimer now) it was a 4-5 YEAR wait for LC, then another year for I-140 (as there was no PP). And in 2001-2003 not all companies that sponsored LCs survived to see what came out of that process, and the sponsored employees were left with nothing.

Hello,
As my lawyer has used his checks to pay my 485/765/131 fees, there is no way of knowing whether the checks have been cashed. I did called my attorney a couple of times last week and he told me that checks are NOT yet cashed.
So I'm still waiting to hear from the lawyer abt the receipts.
And it looks like your package was handled at NSC itself, instead of getting transfered to TSC or CSC, hence the LIN#.
I will let you know once my receipts are in.

Well, following the discussion on BS and MS grads and some of the members cribbing why the MS(from US) students get special treatment, here are my 2 cents.
1) By makng sure that a person is MS they are making sure the population getting greencard is YOUNG !! , it's simple, highly educated "kids" who understand the US culture, since they have studied in US universities and have a whole life ahead of them to do good in Research etc.
Kids gel in fast for e.g if you see a person with BS and MS from the US, his behaviour is attuned to the society as compared to one who just has a MS and a BS from India.
2) On the other hand someone who has a MTech or worked 10 years in India, chances are these guys are already in their late 30's or 40's, so they are not getting the youth in, or a person who will take a lot more time to gel in the soceity as compared to the student.
3) Most importantly, they can't trust people whose degrees are not from the US. Their quality of education, their authenticity. Also, I think the quality of top 100 US univs, which most indians come to anyway, is much better than most of Indian Univs for MS. The kind of infrastructure and teaching they are exposed to is tremendous.
PS: Someone mentioned that PhD's get paid for reseach. Doing researrch is extremely demanding. I would rate it twice as demanding as a regular job! and the amount the students get is peanuts! Like ~$1500 a month for working ~ 60 hrs a week in research is hell !!
Unfortunately, in doing this you may loose some really good candidates, who may not have a US degree, but thats the price you pay "to be safe than sorry"
I think, this should help people who were complaining about this difference better understand that even though they have better profile, it's from a different country and it becomes difficult to verify that.

hi all,
Thanks a lot for all ur suggestions and support. As of now, nothing is moving on in my issue. The last correpondence with the employer was only when i sent mail asking for my money and got reply saying that they will contact their attorney to see what legal action they can take using non compete agreement. But till today, its calm and they are not replying to any of my mails or calls. I feel like its just a mail to scare me......took an appointment with attorney to discuss this and be geared up for action........

I understand that you want to use experience before PD. However, there is no much gain and makes it more complex.
For example, the person who does not start PD for 5 years on work can get only 6 months earlier preference.

I gave more points to PD month than experience month.
If you think its more complexes then I will go with PD only.
New PD means either you are new in US or you dint applied or you got laid off. What ever is the reason of new PD, you or your luck are involved so only you should be responsible. My previous PD was Jul, 2003 with EB2 but INC canceled my company’s LC in group because my company didn’t apply from co-operate office and there was no one in office during INC raid. Later my company applied LC from co-operate office and I got new PD. Even though It would be unfair to talk about experience because some how my or me are involved here.
So let’s keep only PD as only preference.

Wanted to let everyone know of my experience. I dont physically have my card, but there is an approval notice on the USCIS website.
Priority date October 20th 2005
I opened a service request on Monday August 16th. The person on the other end of the line was extremely polite and nice. I told him I had a speaking engagement in Canada (which is the truth) and that if my case was expedited, I would not have to apply for a visa. He given me a SR number and asked me to wait for 30 days which I was prepared to do. However my case status changed online on August 19th. I am unsure as to whether this was because of the service request or things would have taken this route anyway.

Are we sure that there are around 5-6k EB3 pending in the years 2002 and 2003. If thats true then it will take atleast 6 more years to process all the EB3's for 2002 and 2003 :(

I thought all the fees are to be paid by the employer then how come you are paying for it, is it still an option or is there any premium processing for 485
Actually I paid for all the fees from my personal checks. Later on my company reimbursed those. I dont think there is a premium processing for 485.

Has anyone with approval from 08/01 received welcome letter or card? My husband's I485 was approved on 08/04 but no letter or card yet. Also, mine and my son's cases are still pending, opened SR and will take infopass next week.

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.
SKILL bill, OMNIBUS, etc. comes and goes. IV does seem to be doing things to lobby for the community, but let's face one reality. Like a news article said, no one in congress or senate wants to touch immigration even with a long pole until 2009.
The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

After two years in the US, I told my employer that I want to file for GC...
Going to and fro he spent 8 months sayign that he is in the process of doing it...Then he gave me the papers to sign...After that he kept telling me that the lawyer had filed it for one and a half year...In April 04 employer changed lawyers...The new lawyer tried to find all cases at the DOL...My case and one of my friends case is 'missing'...They telling me that is old lawyers fault.....They told us to file a new cases...I am sitting around since July 04.....I am so sick of this whole thing.....
July 04 was my chance to change job or go back...I decided to stick with the job...my bad...Now I am really stuck.....Am waiting for 8th year extension...Wife finishing MS in May and baby on way....I am stuck with dead end job...not well paid......

The only clarification I would make over Knnmbd's interpretation is that as long as you have a US master's degree or higher, the "3 years work experience in a related field" restriction will not apply. If you read section 201 carefully, you will see that the difference between items 1 and 2 is that item 1 refers to US advanced degree holders while item 2 refers to advanced degree holders (resumably non-US educated). The 3 year restriction only applies to those who fall into item #2.
So, if
a) you have a MS from a US university, you and your immediate family (spouse and minor children) will not be subject to the 3 years restriction and will be exempt from the Visa Cap
b) you have a masters or higher from an acredited non-US university, then the Visa Cap will not apply to you and your family, but you shouldd have worked in the US in a "related" field for 3 years.
My question to everyone:
Will folks in section 201 be required to get a Labor certification? If not, then this will provide relief to a lot of us stuck in the BECs.
Knowledgeable folks, please comment.
REMINDER: Any such bill is still MANY months away from seeing the light of day, if at all. BUT, favorable bills such as these give us hope.

This is a �WIN WIN� situation for a lot of people if SKIL goes through.
There is no surprise as to why the Advance degree + 3 years (or no 3 years required in case the advance degree is from a U.S university) clause has found its way into PACE, TALENT, SKIL and was not to mention the failed CIR bill. The bottom line is that there is a sudden urgency to reintroduce the charm of pursuing higher education in the U.S. This benefits the U.S in many ways; universities get more international students paying out of state tuition (good for them specially b�cos the war effort has sucked all resources from educational institutions) and rekindle the brain drain from India and China in the form of researchers and engineers who pursue advance degrees and remain to work in the U.S( it will be surprising if there is no one looking at the booming economies of Asian countries mainly due to number of graduation engineers). So it�s a winning situation for both the U.S to attract smart people, make them spend a �lot� of money in paying tuition in U.S schools and hey what the hell give them a GC to live and work here permanently instead of them heading back home to do great things there.
It works for every one so that�s just great.
